    Treaty concluded between Sam Houston and John Forbes (as commissioners) and the Cherokee Indians on February 23, 1836. Submitted to the Senate for ratification in December 1836. Rejected by the Senate on the grounds that the Consultation had exceeded its powers by confirming Cherokee land grants.

    Background: Cherokee Indians had settled in lands north of San Antonio since 1819. Houston and Forbes were commissioned in December 1835 to negotiate. The treaty was rejected; Houston’s policy of honoring Cherokee claims was reversed under President Lamar. Cherokee were expelled by force in July 1839.
